1. Acceptance of Terms
By accessing and using the Rental Now Leasing Tenant Portal ("the Portal"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Portal.
2. Description of Service
The Portal is a web-based platform that allows tenants to view their rental payment history, lease information, and account details. The Portal also provides property administrators with tools to manage tenant accounts, record payments, and store lease documents.
3. User Accounts
To access the Portal, you must be provided with login credentials by the property administrator. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify the administrator immediately of any unauthorized use of your account.
You must not share your login credentials with any third party. You are solely responsible for all activities that occur under your account.
4. Accuracy of Information
Payment records and lease information displayed on the Portal are entered by the property administrator. While we strive to ensure accuracy, the Portal is a record-keeping tool and does not constitute a legal receipt or proof of payment unless accompanied by independent verification. If you believe any information displayed is inaccurate, please contact the property administrator immediately.
5. Payment Records
The Portal displays payment records as entered by the administrator. The Portal does not process, collect, or handle any actual rent payments. All rent payments must continue to be made through the payment methods agreed upon between you and your landlord as specified in your lease agreement.
6. Lease Documents
Lease documents uploaded to the Portal are provided for your convenience and reference. The uploaded copy does not replace or supersede the original signed lease agreement. In case of any discrepancy, the original signed lease agreement shall prevail.
7. Privacy and Data Protection
Your use of the Portal is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Portal, you consent to the practices described in the Privacy Policy.
8. Acceptable Use
You agree not to:
- Attempt to gain unauthorized access to any part of the Portal
- Use the Portal for any unlawful purpose
- Transmit any malicious software, code, or material
- Interfere with the operation of the Portal
- Impersonate any other person or entity
- Share your account credentials with unauthorized parties
9. Limitation of Liability
The Portal is provided "as is" and "as available" without warranties of any kind, either express or implied. Rental Now Leasing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Portal, including but not limited to errors or omissions in payment records, service interruptions, or data loss.
10. Service Availability
We do not guarantee uninterrupted access to the Portal. We may temporarily suspend access for maintenance, updates, or for reasons beyond our control. We will make reasonable efforts to provide notice of planned maintenance.
11. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the Portal. Your continued use of the Portal after changes are posted constitutes your acceptance of the revised terms.
12. Termination
We reserve the right to terminate or suspend your access to the Portal at any time, with or without cause. Upon termination of your tenancy or lease agreement, your access to the Portal may be deactivated.
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.
